Terms and Conditions
The General Terms and Conditions of booking stipulated in this document apply to all products and services provided by MENARA TOURS. The client agrees to comply with these General Booking Conditions, which they have read before making the reservation and accept without reservation. These General Conditions shall take full effect and prevail over any other provision unless a written waiver is granted by MENARA TOURS.
2.1 Contracting Party
The travel contract is concluded with MENARA TOURS based on the type of product(s) or service(s) the client reserves. When the reservation is made with a service provider, MENARA TOURS acts as an intermediary between the client and this service provider.
The contract will therefore be subject to the General Terms and Conditions of Sale of this provider, who may limit or exclude their liability without this exclusion of liability meaning an increase in our liability. The client may, if applicable, refer to the website of each provider for the General Terms and Conditions of Sale applicable to consumer clients or request any additional information from their travel advisor. In any case, MENARA TOURS can only consider claims involving its direct and proven liability.
2.2 Conclusion of the contract
All reservations are made subject to availability. The customer has the opportunity to check the content and total price of their reservation as well as to correct any potential errors before confirming their order. Unless otherwise stipulated in these General Booking Conditions, the contract will come into effect as soon as MENARA TOURS has received the client's actual payment.
The client acknowledges having read these General Terms and Conditions of Service and having reviewed the offer conditions before proceeding with the confirmation of the purchase of the service and its payment. It is the client's responsibility to print or save all contractual documents. A copy of the contract will be automatically kept in the MENARA TOURS records.
The data collected regarding the clients are processed in accordance with the provisions of Law No. 09-08 relating to the protection of individuals with regard to the processing of personal data. The client acknowledges being informed that there may be processing fees per reservation file and/or per person depending on the product booked. The client will be informed of any potential fees upon confirmation of their reservation. These booking fees may be changed without notice and can be increased, decreased, or removed.
The travel prices are those mentioned at the time of your purchase. In the event of registration and non-confirmation or non-payment of the total amount for the purchased product, MENARA TOURS reserves the right to review these prices without notice in case of changes in economic conditions (for example, increase in fuel prices, airport taxes, value-added tax, exchange rate changes, etc.).
4.1. Reservation:
Before any reservation, the client logs into their account: username and password. In order to make your reservation, you must add the product of your choice to your cart. Your reservation will be considered from the moment you have completed the steps in your cart: choosing the payment method, validating the final quote, and confirming the reservation. The payment will be processed as soon as the reservation is made.
4.2. Confirmation:
The final confirmation of your cart can only be made after full payment of your order and confirmation of the availability of the reserved product.
5.1 Payment method:
- To pay for your order, you choose the payment method from those offered by MENARA TOURS on the payment page.
- In the case of an online payment, the transaction for debiting your account is processed on the day following the confirmation of delivery.
- Your Multi-channel payments are secured by the Interbank Monetary Center (CMI), which offers a fully secure payment service.
- The Consumer guarantees MENARA TOURS that they have the necessary authorizations to use the payment method they have chosen at the time of validating the Order Form.
- In the case of payment by credit card, the provisions related to the fraudulent use of the payment method provided for in the agreements concluded between the Consumer and the card issuer, as well as between MENARA TOURS and its banking institution, apply.
5.2 Proof of transactions paid by credit card:
- The data recorded by CMI on the Multi-channel payment platform on behalf of MENARA TOURS constitute proof of all commercial transactions conducted between you and the company MENARA TOURS.
5.3 Other payment methods:
For all reservations on the site, only the following payment methods are accepted:
1 - Credit card
2 - Bank transfer
Any reservation must be accompanied by the following payments, failing which it will be canceled:
1st deposit of 50% of the sale price payable upon registration.
2nd deposit of 50% of the sale price payable 15 days before departure.
Any request for modification is subject to availability, as well as the limitations and restrictions set forth by MENARA TOURS.
The modifications must be requested by the client by contacting the agency via email or phone. If the modification results in an increase in the reservation price, the customer will have to pay the additional costs plus the modification fees.
However, in the case where the reservation price is lower after modification, the difference will be refunded taking into account the modification fees. MENARA TOURS reserves the right to cancel any trip in case of force majeure, political unrest, strikes, as well as other circumstances that compel it to abandon the execution of the trip. Similarly, MENARA TOURS reserves the right to interrupt a trip already in progress. In case of cancellation by MENARA TOURS, the client will receive a full refund for the trip.
The client will have the option to cancel their trip at any time, but they will owe MENARA TOURS the following penalties on the trip price:
Cancellation of travel within a period of:
- More than 60 days before departure 5% of the sale price
- 60 days to 40 days before departure 25% of the sale price
- 39 days to 30 days before departure 50% of the sale price
- 29 days to 16 days before departure 75% of the selling price
- 15 days before departure 100% of the sale price
No refund will be issued in the following cases:
Request for cancellation of the trip by the client within 24 hours before departure;
Non-presentation on the day of departure; Trip interruption at the client's initiative;
Non-attendance of the client at one of the scheduled
The retailer and the organizer are responsible for the proper execution of the travel services provided for in the contract and are required to assist the traveler if they are in difficulty. Under no circumstances shall MENARA TOURS be held liable for damages attributable either to the traveler, or to a third party unrelated to the provision of travel services included in the contract, or to exceptional and unavoidable circumstances. The Agency holds the legal and administrative authorizations issued by the competent Moroccan authorities, ensuring clients the proper execution of the purchased services. In the case of package tours, the liability of the seller of the tourist service is defined by the Tourism Code and cannot be engaged in the event of contractual non-performance by the client, in the event of a third party's actions, or in the event of force majeure. The liability of the Travel Agency may be limited by that of its own service providers through the application of international conventions, particularly for air transport, the Warsaw Convention of October 12, 1929, as amended, and the Montreal Convention of May 28, 1999 (Article L211-16 of the Tourism Code).
The Site cannot be held responsible for changes in dates, times, or itineraries, changes in return airport, removal or modification of part of the program caused by external events such as strikes without notice, technical incidents, flight overbooking, bad weather, epidemics, flight changes, or any other case of force majeure, due to third parties unrelated to the provision of the services stipulated in the contract, or for the poor execution of the contract attributable to the client. It may happen, due to reasons related to the period, the number of visitors, or decisions made by the hoteliers on-site, that the equipment is insufficient in number at the accommodation or that certain activities are suspended. The Site shall not be held responsible in the event of an incident occurring due to services purchased directly on-site by the client from an external provider or resulting from the client's personal initiative.
MENARA TOURS is not responsible in case of loss or theft occurring in hotels or coaches. It is recommended that clients deposit valuables, identification papers, and travel documents in the hotel safe. The client is responsible for the forgetting or loss of items that occur particularly during transport or transfers and during the stay. It is also advised against leaving any identification papers, essential medications, valuables, cash, cameras, electronic devices, etc., in the luggage entrusted to the carriers.
The client can declare the value of their belongings at check-in. It is the client's responsibility to adhere to all safety rules and instructions. The client must exercise common sense, caution, and prudence during the activities in which they participate. It is the client's responsibility to respect the internal regulations of the hotels where they stay and not to display incivility during their trip. Otherwise, the hotelier and/or MENARA TOURS will be authorized to terminate the client's stay due to their improper behavior. In such a case, the client will not be entitled to any refund or compensation and will bear all the costs resulting from the interruption of their stay.
No individual travel insurance is included in the rates. We recommend that you subscribe to it before departure to cover all risks related to repatriation, hospitalization costs, trip cancellation, etc.
If the client is disabled or has reduced mobility or requires special assistance for any reason, they must inform MENARA TOURS at the time of booking. In the event that these requirements change before departure, the client must inform MENARA TOURS.
The client is required to inform MENARA TOURS of any special requests they may have, which will be responsible for forwarding them to the appropriate supplier. However, MENARA TOURS does not guarantee the response to these special requests as it has no direct control over how the services are provided.
The client agrees to comply without restriction with the rules and laws of the visited country. The company MENARA TOURS declares itself not responsible for any act or offense committed by the client on foreign teritory.
No personal information is collected without your knowledge. In a spirit of respect for privacy, the travel agency MENARA TOURS is committed to ensuring that the collection and processing of personal information are carried out in accordance with Law No. 09-08 of February 18, 2009, relating to the protection of individuals with regard to the processing of personal data. No personal information is transferred to third parties.
